Adam Rickabaugh's Estate

The State of Ohio Gallia County

Be it remembered that heretofore [____] at a court of Common Pleas at the court house in the town of Gallipolis within and for the said court on the twenty first day of October in the year of our Lord one thousand eight hundred and thirty six. The last will and testament of Adam Rickabaugh late of this county [accused] and presented to the court for probate and [___]. John Gibson Elizabeth Gibson and John White the three subscribing witnesses thereunder [___] before the court and after being duly sworn state to the court that they were present when the testator signed and acknowledged [____] his last will and testament that they believe he was of sound mind and understanding at the time of signing and acknowledging the [___] that they believe the testator at the time of signing the same was over the age of twenty one years [___] will was made without any compulsion and that they signed the same [___] thereunto at the request and in the presence of the testator and of [___] and there up objections being made to said will and after hearing in testimony on both sides the same is continued until tomorrow morning.

And afterwards to wit on the 25 day of October last aforesaid and at the court aforesaid the said last will and testament of Adam Rickabaugh which having been duly proved on the fifth day the present [___] and the objections to the same having been heard and [___] to the and [___] and the court having fully advised in the [___] do order that said will be recorded and it is also further ordered that the costs of the contest of said will be paid by John Rickabaugh and Martin Koontz the [___] of said will and thereupon John Rickabaugh the executor in said will named came before the court and accepted the same and now duly sworn and gave bond with James Wood and Harrison Wood his securities to the [___] of the court in the penalty of twelve hundred dollar conditioned [_________] it is ordered that letters

On Application [___] that Nehamiah Atwood & William Ridgeway and Philip [___] after being duly sworn appraise the personally [___] which [__] of Adam Rickabaugh deceased and they [____] return according to Law.

And which said last will and testament in the and figures following to wit.

I Adam Rickabaugh of Gallia County and State of Ohio do [make] this my last will and testament hereby revoking and making void all former wills by me at any time heretofore made and first I direct that after my death my body be decently interred in the burying ground on my farm by the side of my last and beloved wife Polly and that my funeral be conducted according to the rites and ceremonies of the Church of the regular Baptists corresponding with my estate and [situation] in life and to [___] Estate at is hath pleased Almighty God to [_____] and that that may remain and belong to my estate at my request it is my will to dis[__] a follows.

First I direct that all of my just debts and funeral expenses be paid [___] feasible after my decease out of the property hereunder [___]

Second, I direct my daughter Teny [___] have house fifteen dollars

Fourth I direct that my son John have seventy five dollars. Fifth I direct that my daughter Elizabeth's Lawful heirs have fifteen dollars sixth I direct that my son P___ have twenty five dollars seventh that my daughter Polly have 20 dollars eighth I direct that my son Joseph have one hundred dollars ninth I direct my daughter Rachel have twenty five dollars tenth I direct that my daughter Mahaly have one hundred dollars at the time of her marriage if that same happens. Eleventh I direct that my daughter Anne have twenty five dollars and one half of my household furniture [alo] to live on my farm and in my house until may decease and one year after that [___] happens Twelfth and thirteenth I direct that my two sons Adam and William have all of my farm whereon I now live and one half of the household furniture fourteenth I direct that after fair valuation according to law be sold by my executor for cash and if my property be sold by any executor amount to a sum [_____] to pay my sons and daughters above named shares and a reasonable compensation to my executor and if not I direct that my two sons Adam and William pay the remainder and I hereby make and ordain my son John Rickabaugh executor of this my last will and testament: In writings thereof I Adam Rickabaugh the testator [___] to this my will written on one sheet of paper [__] my hand and seal this fourteenth of June in the year of our Lord one thousand eight hundred and thirty six [____] sealed and delivered in presence of us who have [___] in presence of each other.

And afterward to wit on the sixth day of February in the year of our Lord one thousand eight hundred and thirty seven the said aforesaid filed in the clerks office of this bench the following inventory and apportionment the goods and chattels which [__] of the said Adam Rickabaugh deceased to [___] [___} inventory of the goods and chattels of Adam Rickabaugh raccoon township Gallia County and State of Ohio Deceased as presented to the [___] William Ridgeway Nehemiah Atwood Philip Wolfenbarger appraiser appointed by the court of common pleas of Gallia County by John Rickabaugh [___] date this 11th day of November 1836.
